Minor Traffic Violations:

While any traffic violation has the potential to become a major incident, some are considered more extreme violations than others and carry more substantial penalties.  Minor violations include failing to signal when changing lanes, failing to wear a seatbelt, stop sign violations, parking violations, following too close, expired registration and speeding.

Generally, breaches such as these will put points on your license as a deterrent to repeat offending and as a way of encouraging you to improve your driving skills.

More severe traffic violations can include:

  • Speeding
  • Texting While Driving
  • Not Wearing a Seat Belt
  • Running a Red Light
  • Driving with a Suspended License
  • Reckless Driving
  • Leaving the Scene of an Accident
  • Hit-and-Run Accidents

These violations can cause a higher degree of harm to both the driver and other road users and, as such, have higher penalties.

What are Traffic Points?

If you receive a ticket for a traffic violation, points may be assigned to your license.  Each state assigns points to each traffic offense, depending on the severity of that offense. For example, in Florida, a stop sign violation puts three points on your license, whereas speeding carries 3 to 4 points, depending on how far over the speed limit you were traveling.

It is up to the DMV (Department of Motor Vehicles) in each state to keep a record of points that have been assigned to your license. The more points on your license, the more likely it is to impact your driving record negatively and increase your insurance premiums. Should you reach the maximum number of points on your license, you may face suspension from driving for some time.

It is possible in certain circumstances to have points removed from your license. If you have concern over points on your license or if you would like to dispute any traffic violation tickets, Garcia & Qayum Law Group has a talented team of legal professionals ready to fight in your corner.

Serious Violations:

Ironically, more severe traffic violations do not put points on your license. While this may seem better initially, unfortunately, the penalties are more immediate and have a long-lasting impact for you as a driver.

Penalties can range from license suspension or driving disqualifications to jail time in very extreme cases, or if you are a repeat offender.

No Valid Driver’s License:

Driving without a license is referred to as NVDL (No Valid Driver’s License) offense. Of course, this cannot put points on your license as you do not have one. However, this is a serious criminal offense and may result in jail time in the case of repeat offending.  It may also alert ICE officials as to your presence in the United States

Driving with a Suspended Driver’s License:

If you are convicted of driving with a suspended driver’s license, your license may be revoked for up to five years. If you continue to offend and are caught driving with a suspended driver’s license a second time, you may face a felony charge.

DUI (Driving Under Influence):

This refers to driving under the influence of both alcohol and drugs. While a DUI does not put points on your license, you will have your license suspended for a minimum of 6 months. A DUI may also incur extra penalties, will increase your insurance premiums drastically and may end up putting you in jail.

A DUI can be disputed, with several ways to contest a failed breathalyzer test, from incorrect machine calibration to personal physiology.
